Free speech and privacy: context-specific?

One of the most interesting things that (for me) came out of Nicole's visit last Thursday (see good summaries of our discussion by rmeyers and jrf) was her suggestion that questions of intellectual property may well be context specific; an interesting follow-up to that idea is highlighted in today's NYTimes article contrasting U.S. ideals of free expression w/ European ideals of privacy: When American and European Ideas of Privacy Collide.
